Sánchez pardons artist Natalio Grueso on humanitarian grounds

The Government of Pedro Sánchez has decided to pardon artist and cultural manager Natalio Grueso from serving his remaining prison sentence, citing humanitarian reasons linked to his health condition. The measure, adopted before the summer recess, comes after a legal battle that has divided opinions in the Spanish cultural sector.

A controversial pardon with support from the artistic sector

Grueso was sentenced to eight years in prison, another eight years of disqualification and a fine for misappropriating funds from the Niemeyer Foundation, the Asturian cultural centre he directed. According to eldiario.es, he used false or altered invoices to profit himself, his family members and friends, with an embezzlement totalling around 78,819 euros.

The pardon request originated from Catalan singer-songwriter Joan Manuel Serrat, Princess of Asturias Award for the Arts 2024, and gained support from around 70 more people from the world of art and audiovisual media, including singers Ana Belén and Víctor Manuel. The Executive has justified the grace measure based on this broad backing.

Justice opposed it: a conflict with the courts

However, the Government's decision directly conflicts with the position of the Asturian Provincial Court, which in March issued an unfavourable report on the pardon. The court argued that Grueso did not deserve this measure because he fled the country to avoid entering prison after the Supreme Court confirmed his conviction.

He remained a fugitive from justice for more than two years. It is on record that he attempted to evade judicial action on two separate occasions until he was detained in Portugal under a European Arrest Warrant. For the magistrates, this conduct should count against him, not in his favour.

The Public Prosecution also opposed it, noting that Grueso did not meet the legal requirements because he was never available to the sentencing court to voluntarily serve his sentence, one of the exceptions contemplated in pardon regulations.

What it means in practice

The partial pardon approved by the Government exempts him from serving the custodial sentence, but does not affect the disqualification or the fine. Although it has not yet been disclosed what his exact situation will be in the coming months, the measure effectively means that Grueso will not set foot in a cell.

This is not the only pardon approved in the summer batch: the Executive has granted a total of five partial pardons before the summer recess, although Grueso is the one that has generated the most controversy due to the contrast between artistic support and judicial opposition.

A precedent that reopens the debate

The decision reignites criticism over the political use of pardons and the limits of executive power in matters of clemency. While the cultural sector sees in Grueso a sick manager deserving of mercy, Justice portrays him as someone who deliberately evaded his criminal responsibility. The gap between both positions remains wide open.
